Motohub Terms of Service
Welcome to Motohub. These Terms of Service (“Terms”) are a legal agreement between you and Motohub, Inc. (“Motohub,” “we,” “us,” or “our”). By accessing or using Motohub’s website, mobile application, or related services (collectively, the “Services”), you agree to be bound by these Terms and all policies incorporated by reference. If you do not agree, you may not use the Services.
Introduction
Motohub is an online marketplace designed for motorsports enthusiasts. The Services connect buyers and sellers of parts, gear, and accessories, and in some cases Motohub itself may act as the seller of goods (“First-Party Sales”). Unless explicitly stated, Motohub does not own, inspect, or guarantee the items listed by third-party sellers.
You must be at least 18 years of age, or the age of majority in your jurisdiction, to use the Services. By using Motohub, you represent and warrant that you meet these eligibility requirements.

You agree to abide by all such policies as a condition of using the Services.
Accounts
Accounts must be created using OAuth (such as Google or Apple). Guest checkout is not supported. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.
Each individual may maintain only one account. The creation of multiple or fraudulent accounts is prohibited. Motohub reserves the right to suspend or terminate accounts for violations of these Terms.
Roles and Responsibilities
Sellers are solely responsible for accurately listing their products, shipping items in a safe manner, and ensuring they are delivered undamaged to buyers. Buyers are solely responsible for confirming compatibility of parts with their vehicles. Compatibility tools offered by Motohub are provided as a convenience but do not guarantee accuracy.
Motohub facilitates the marketplace, processes payments, may provide shipping tools, and offers dispute resolution, but it does not act as the seller of third-party goods and does not guarantee item condition or fitment.
Listings and Content
Sellers must provide accurate product information, including condition, OEM or aftermarket designation, brand, and compatibility details. Items that are counterfeit, stolen, unsafe, or illegal may not be listed.
Motohub reserves the right to remove or edit listings that violate its policies. Any listing with no views, messages, or other interaction for a period determined by Motohub may be removed as dormant. By posting a listing, sellers grant Motohub a limited license to display and use such content within the Services.
Payments, Fees, and Taxes
Payments are processed by Stripe or other third-party providers. Sellers are responsible for all transaction fees, cancellation fees, and other charges set forth in the Fee Structure. Negative balances must be promptly repaid. Motohub may collect and remit sales taxes where legally required. Sellers remain responsible for all other applicable taxes. Sellers must also comply with California Proposition 65 and any other labeling or product warning obligations.
Shipping and Delivery
Sellers must provide valid shipping methods and tracking numbers. While Motohub may offer shipping labels or integrations, sellers remain solely responsible for fulfillment and delivery.
Sellers must ship within three (3) business days unless otherwise stated. Risk of loss remains with the seller until delivery is confirmed by the carrier.
Returns and Buyer Protection
All returns and refunds are governed exclusively by the Motohub Return Policy & Buyer Protection, which is incorporated by reference into these Terms.
Buyers and sellers must comply with all procedures, evidence requirements, and timelines specified in the Return Policy. Failure to comply may result in cancellation of the return and release of funds to the seller. All determinations made by Motohub Support in connection with returns or Buyer Protection are final. The Return Policy may be updated independently of these Terms, and continued use of the Services constitutes acceptance of any such updates.
Credits, Promotions, and Referral Programs
Motohub may issue referral credits, promotional codes, or discounts. Such credits and codes are not redeemable for cash, may expire, and may be revoked in cases of misuse. They may not be sold, transferred, or used fraudulently.
Reviews and Ratings
Buyers may post reviews and sellers may respond. Reviews must be truthful and may not be fraudulent, retaliatory, or manipulative. Motohub reserves the right to moderate or remove reviews in limited circumstances.
Vehicle Compatibility Data
Motohub provides vehicle compatibility data to assist sellers in identifying potential fitment for parts. This dataset originates from third-party and public sources, curated specifically for motorsports applications. Buyers remain responsible for confirming actual fitment. Compatibility data is offered solely as a convenience and is not guaranteed to be accurate. Motohub does not redistribute raw schemas, categories, or proprietary third-party data.
Third-Party Integrations and API Use
Motohub provides optional integrations that allow sellers to synchronize inventory from third-party marketplaces or tools. Such integrations require explicit authorization from the seller. Motohub stores only the data necessary to facilitate synchronization, fulfillment, or order updates, and does not use such data for marketing or resale. Sellers remain responsible for compliance with the terms of any connected third-party platform.
Community Guidelines and Prohibited Uses
Motohub is built on trust within the motorsports community. To maintain a safe and respectful marketplace, the following activities are prohibited:
- Violating applicable laws or third-party rights
- Selling counterfeit, stolen, recalled, unsafe, or illegal goods
- Circumventing Motohub fees or transacting off-platform
- Harassing, threatening, or abusing other users
- Artificially manipulating prices, reviews, or search results
- Engaging in fraudulent transactions such as false returns or chargebacks
- Posting discriminatory, defamatory, hateful, or sexually explicit content
- Introducing malware, bots, scrapers, or other disruptive technologies
- Misrepresenting identity or creating multiple accounts
Violations may result in removal of listings, account restrictions, suspension, or permanent bans. Serious violations may be reported to law enforcement. Users are encouraged to report violations through platform tools or by contacting support@motohub.co.
Limits on Use and Storage
Motohub may impose limits on data storage, account activity, and use of the Services. Listings with no activity for a period determined by Motohub may be removed. Inactive accounts and old data may be deleted. Motohub does not guarantee permanent storage of listings, orders, or messages.
Dispute Resolution
Buyers and sellers must first attempt to resolve disputes through Motohub messaging. If no resolution is reached, Motohub Support may intervene and issue a binding resolution for the transaction.
All disputes between you and Motohub shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. Claims may only be brought on an individual basis and not as part of a class, consolidated, or representative action. You may bring qualifying claims in small claims court.
Motohub will pay the AAA administrative fees for claims under one thousand U.S. dollars (USD $1,000), unless the arbitrator determines the claim to be frivolous. For all other claims, the allocation of fees and costs shall be determined in accordance with the AAA rules, and the arbitrator may reallocate fees as part of the award. Each party shall bear its own attorney’s fees unless applicable law requires otherwise.
The arbitrator shall apply the Limitation of Liability provisions set forth in these Terms, and in no event may the arbitrator award damages or relief exceeding those limits.
You may opt out of arbitration by providing written notice to Motohub within thirty (30) days of accepting these Terms. These Terms are governed by the laws of Delaware, and any court proceedings permitted under this Section shall be brought exclusively in the state or federal courts located in Delaware.
Intellectual Property and Takedown Policy
Motohub respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). Copyright holders may submit takedown notices to dmca@motohub.co containing the information required by law. For trademark disputes, contact ip@motohub.co. Counter-notices may be submitted if a user believes content was removed in error, and content may be restored if no court action is filed within the statutory period. Accounts of repeat infringers will be terminated.
Indemnification
You agree to indemnify and hold harmless Motohub, its officers, employees, and affiliates from any claims, damages, losses, or costs arising from your listings, your violation of applicable laws or third-party rights, or your misuse of the Services.
Limitation of Liability
Motohub provides the Services “as is” and “as available” without warranties of any kind. For transactions between users, Motohub acts solely as a marketplace facilitator and does not own, inspect, test, or guarantee the condition, safety, legality, or compatibility of items listed by third-party sellers. In the case of First-Party Sales, Motohub’s liability is limited to repair, replacement, or refund of the purchase price, at its sole discretion.
To the fullest extent permitted by law, Motohub shall not be liable for indirect, incidental, special, punitive, or consequential damages, including loss of profits, data, or goodwill. Motohub’s total liability for all claims—whether in court, arbitration, or any other proceeding—shall not exceed the greater of (a) the total fees paid by you to Motohub in the six (6) months preceding the claim, or (b) one hundred U.S. dollars ($100). These limitations reflect the allocation of risk between the parties and shall survive even if any remedy fails of its essential purpose.
Electronic Communications
By using the Services, you consent to receive notices, disclosures, and communications electronically, whether by email, in-app message, or posting on the site. Such communications satisfy any legal requirement that they be in writing.
Termination
You may close your account at any time. Motohub may suspend or terminate your account for violations, fraud, or misconduct. You remain responsible for pending transactions, fees, or disputes even after termination.
Force Majeure
Motohub shall not be liable for any delay or failure in performance caused by events beyond its reasonable control, including natural disasters, acts of war, terrorism, labor disputes, government actions, internet outages, cyberattacks, pandemics, or failures of third-party service providers. Obligations will be suspended during such events, and Motohub will make reasonable efforts to resume normal operations. If such an event continues for more than sixty (60) days, either party may terminate the affected Services upon written notice.
Changes to Terms
Motohub may update these Terms at any time. Notice may be provided via the Services, email, or in-app notification. Continued use of the Services constitutes acceptance of updated Terms.
